End User License Agreement (EULA) for Phoenix Home Cleaning

Effective Date: July 7th, 2024

1. Introduction

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Phoenix Home Cleaning ("Company," "we," "us," or "our") governing your use of our cleaning service platform (the "Service"). By accessing or using the Service, you agree to be bound by the terms and conditions of this Agreement.

2. License Grant

Phoenix Home Cleaning grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal use in accordance with this Agreement.

3. Restrictions

You agree not to:

• Use the Service for any unlawful purpose.
• Modify, adapt, translate, or create derivative works based on the Service.
• Reverse engineer, decompile, or disassemble the Service.
• Remove any proprietary notices or labels from the Service.
• Use the Service in a manner that could damage, disable, overburden, or impair our servers or networks.

4. Intellectual Property Rights

All intellectual property rights in the Service, including but not limited to copyrights, trademarks, and trade secrets, are owned by Phoenix Home Cleaning. This Agreement does not grant you any rights to use our trademarks or other intellectual property.

5. Privacy

6. Termination

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Phoenix Home Cleaning does not warrant that the Service will be uninterrupted or error-free.

8. Limitation of Liability

In no event shall Phoenix Home Cleaning be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.

10. Changes to this Agreement

We reserve the right to modify this Agreement at any time. We will notify you of any changes by posting the new Agreement on our website. You are advised to review this Agreement periodically for any changes. Changes to this Agreement are effective when they are posted on this page.
